The offenders who fall into that category are those who were convicted before the devices became law in 2007. The New Jersey Supreme Court has ruled that the state can't force sex offenders convicted before a GPS monitoring program was signed into law to wear the tracking devices.  The justices voted, 4-3, that it was unconstitutional for the state Parole Board to require a suspect who served 23 years for attempted assault of a minor to wear the device after he was released from prison in 2009.
